U.S.A Trademark Registration Process
The out-of-pocket cost for a thorough trademark search is $575 for a word or phrase, and $500 for a design. If a mark contains both words and designs and we are to search them both, you add the two or $1075 â€“ again just for costs. Add legal service fee to review the results and prepare an opinion (usually about $400-$800) and you get about $1,000-$1,500 total for each search.
$325 per class, so the broader you go with the descriptions the more classes you likely fall in at $325 each. Legal service fee for preparing and filing the application is about $500-600 for a single class, with multiclass applications being usually a little more ($100-300). Total filing fees (filing fees and service fees) are somewhere in the vicinity of $900 to $1,500 unless there are multiple classes which require additional fees. However, as with anything it can run higher if there are complications.
In addition, we will need to be able to identify the goods and/or services to which the mark will apply. The identification of goods and/or services must be specific enough to identify the nature of the goods and/or services. See links below for trademark classification list. Education and Entertainment This class contains mainly services rendered by persons or institutions in the development of the mental faculties of persons or animals, as well as services intended to entertain or to engage the attention of others.
NOTE: From date of filing to the registration date, it takes approximately 12-18 months to receive a Certificate of Registration. There are many factors that affect how long it takes to register a trademark. No guarantee your trademark will ever register, as it may be refused for various legal reasons.
International Registration Process
Costs vary widely and are country-by-country so to register in many countries would be thousands, if not tens of thousands. Rough estimate, $2,000-5,000 per country. In the US, there are costs associated with filing and after that costs associated with prosecution of the application to registration of the trademark in that country. Outside counsel will need to retain foreign attorneys in these foreign jurisdictions.
